Bon Sejour Travels does not organize, operate or execute travel services and does not act as a travel organizer, tour operator or service provider.
By accessing the website, submitting a booking request or making any payment, the customer acknowledges that they have read, understood and accepted these Terms & Conditions, which constitute a legally binding agreement governing the contractual relationship between the customer and Bon Sejour Travels.
Bon Sejour Travels (www.bonsejourtravels.com) operates exclusively as an independent intermediary, booking facilitator and payment collection agent, whose activity is strictly limited to the intermediation, coordination and facilitation of reservations between customers and independent third-party service providers. Bon Séjour Travels does not act as an organizer, tour operator, carrier, accommodation provider, activity operator or service executor, and does not own, manage, operate, supervise or control any of the services offered or booked through its platform. All services are executed exclusively by independent third-party providers acting in their own name, under their own legal, contractual, regulatory and operational responsibility, without any subordination, joint control or agency relationship with Bon Séjour Travels beyond the strict limits of booking intermediation.
The customer expressly acknowledges and agrees that Bon Sejour Travels does not sell, organize or offer package travel, combined travel services or any form of travel arrangement within the meaning of applicable consumer or tourism regulations. Each service booked through the platform constitutes an independent and autonomous service, giving rise to a distinct contractual relationship concluded directly between the customer and the relevant third-party provider. The aggregation of multiple services, whether booked simultaneously or separately, shall not under any circumstances result in the legal qualification of package travel, travel organization or joint performance. The customer expressly waives any claim, action or attempt to requalify Bon Sejour Travels as a travel organizer, tour operator, principal contractor or co-provider.
The customer expressly acknowledges that no representation, presentation, marketing content or website structure shall be construed as creating a travel package, organized trip or comprehensive travel service. The customer confirms that they do not rely on Bon Sejour Travels as a travel organizer or tour operator, but solely as a booking intermediary facilitating access to independent third-party services.
By making a reservation or payment, the customer acknowledges that Bon Sejour Travels is not a party to the contract governing the execution of the service and assumes no contractual obligation relating to the performance, quality, safety, conformity, legality or suitability of the services provided. Bon Sejour Travels’ obligations are strictly limited to reservation facilitation, transmission of information and payment coordination, without any obligation of result, supervision or verification. Any claim relating to the execution of the service must be directed exclusively against the third-party provider concerned.
Bon Sejour Travels may collect, on behalf of third-party providers, a deposit or the full price of the service, acting solely as a payment collection agent. Amounts collected include an intermediation commission retained by Bon Sejour Travels as remuneration for its services. The customer expressly acknowledges that deposits constitute earned and non-refundable compensation for intermediation, administrative processing and reservation blocking, irrespective of subsequent events. Bon Séjour Travels does not act as an escrow agent and bears no fiduciary obligation beyond the transfer of amounts due to providers under agreed commercial arrangements.
Where a booking provides for a partial payment online and a remaining balance to be paid directly to the third-party service provider on site or at a later stage, Bon Sejour Travels acts solely as an intermediary for the initial payment. Any remaining balance is collected directly by the third-party provider under its sole responsibility and is governed exclusively by the provider’s own payment, cancellation and refund policies. Bon Sejour Travels bears no responsibility for the collection, conditions or execution of such remaining payments.
Unless expressly stated otherwise in writing, all deposits are strictly non-refundable and non-transferable. No refund shall be due in the event of cancellation by the customer, modification request, no-show, early departure, dissatisfaction, force majeure, provider failure or any external circumstance beyond the control of Bon Sejour Travels. Any refund of amounts paid beyond the deposit is subject exclusively to the policies and decisions of the relevant third-party provider, without guarantee or obligation on the part of Bon Séjour Travels.
Cancellation, modification, refund, postponement and rescheduling conditions are determined solely by third-party providers. Bon Sejour Travels does not impose, control or guarantee such policies and shall not be held liable for their application, interpretation or enforcement. Any assistance provided by Bon Sejour Travels in communications with providers is strictly voluntary and shall not constitute an assumption of responsibility or obligation.
Prices are subject to change at any time due to provider updates, currency fluctuations, availability constraints or operational factors. Bon Sejour Travels reserves the right to correct any manifest pricing error, technical malfunction or human mistake and to cancel affected reservations, in which case any amount paid shall be refunded without further compensation. Transaction fees, exchange costs and banking charges remain at the customer’s expense.
Bon Sejour Travels shall not be held liable for any failure, delay, cancellation or modification resulting from events beyond its reasonable control, including but not limited to natural disasters, weather conditions, pandemics, political instability, governmental measures, strikes, transport disruptions, acts of terrorism or war. No refund or compensation shall be due in such circumstances.
To the maximum extent permitted by applicable law, Bon Sejour Travels excludes all liability for any direct or indirect damage, including bodily injury, death, material loss, theft, service failure, delay, inconvenience, financial loss or moral damage arising from or in connection with the execution of services by third-party providers, including any claim based on an alleged duty of care, duty to warn or duty of supervision. In the event that liability were nevertheless retained, it shall be strictly limited to the amount of commission actually received by Bon Sejour Travels for the booking concerned, excluding any indirect, incidental or consequential damages.
Bon Sejour Travels shall not be liable for any damage caused by the customer to the accommodation, nor for any injury, accident or incident occurring within the accommodation, which remain under the sole responsibility of the customer and/or the third-party accommodation provider, as applicable.
The customer expressly acknowledges and agrees that participation in travel services, transport, excursions and activities involves inherent risks, including but not limited to bodily injury, permanent disability or death. The customer remains solely responsible for travel documents, visas, vaccinations, insurance coverage, health condition, compliance with local laws and regulations, punctuality and personal belongings.
The customer further expressly acknowledges that acceptance of these Terms & Conditions constitutes full, unconditional and irrevocable acceptance of the Risk Disclaimer, Assumption of Risk & Liability Waiver document made available on the website and incorporated herein by reference, which forms an integral and binding part of the contractual relationship.
The customer expressly and irrevocably releases, waives and discharges Bon Sejour Travels from any and all claims, liabilities, actions or proceedings arising from or related to such risks, regardless of their cause, including negligence of third-party providers.
Bon Sejour Travels does not provide travel insurance, medical insurance, liability insurance or cancellation insurance. The customer is strongly advised to obtain adequate coverage prior to travel. Failure to do so shall not give rise to any claim against Bon Sejour Travels.
All descriptions, photographs, videos and promotional materials are provided for illustrative purposes only and are non-contractual. Variations may occur due to seasonality, maintenance, provider discretion or external factors.
Customer data may be transmitted to third-party providers strictly for the purpose of service execution. Bon Sejour Travels disclaims any responsibility for data processing practices carried out independently by such providers.
The customer expressly waives any claim, action or proceeding against Bon Sejour Travels arising from the execution of services, the conduct of third-party providers or any incident occurring during travel or activities.
Where required by applicable consumer protection laws, the customer is informed of the possibility to resort to an alternative dispute resolution or mediation procedure prior to any judicial action. Further information may be provided upon request.
These Terms & Conditions are governed by the law of the legal entity operating Bon Sejour Travels, excluding conflict-of-law rules. Any dispute shall fall under the exclusive jurisdiction of the competent courts of the registered office of Bon Sejour Travels, regardless of the customer’s nationality or place of residence.
If any provision is held invalid or unenforceable, the remaining provisions shall remain in full force and effect. In case of translation, the English version shall prevail.
Use of the website, submission of a booking request or payment of any amount constitutes full, unconditional and irrevocable acceptance of these Terms & Conditions.
